Murder: According To Section 302 of the Indian penal
Code, Murder is Defined as the Act by Which the Death Caused is done With
the intention of Causing Death or With The intention of causing Such bodily
injury as the offender knows to be likely to cause the death of the person to
whom the harm is caused or is sufficient in the ordinary course of nature to
cause death Or with the Knowledge that the act is so imminently dangerous that
it must, In all probability, cause death or such bodily injury as is likely to
cause Death.
On 8th March 2012,
a Sad Incident Took place in Banmore at around 1 pm while Mr. Kumar Was
patrolling in his jeep. He Saw the Tractor Loaded with the stones and he got
down of his vehicle and tried to stop it. In the Unknown events that followed,
He Lost his Life when he got caught in the back portion of the Tractor. The
area falls in the Morena District in Madhya Pradesh and The area is rich in
stones which are used in construction.
Till the Evening, all the
News Channels, Whether Local or National, Started Reporting on the matter. The
News Started From “IPS Officer Killed in Morena” and it went to the extent of
“IPS Officer Murdered by The Mining
Mafia”. This indeed was a Tragic Accident, Mind you, I use the Word Accident,
Which shouldn’t have taken place, But that was that, Just a simple accident.
This accident, which was
logically deducible that it was a accident from the reports that followed, Was seen as a point by the
Political parties as a chance at redemption from the electorate and the
Opposition[The Congress party in MP] Joined the “Anti-Corruption Bandwagon” and
Called it a Pre-Planned Murder carried out by the Mining Mafia of the state. I
don’t know where they jumped to that conclusion the only connecting point being
the stones in the tractor’s trolley. The Local Police Denied that the Driver,
Manoj Gurjar, Had any links to the mafia, but when the political parties Insist
on something, That has to be carried on, So a State wide Bandh Was called, and
Was achieved. Also the State Assembly was disrupted, and A CBI inquiry was
demanded for. The state govt. caved in to the pressure and the CBI registered a
Case. Yeah Because Our Top Intelligence agency has no work except trying to
find loopholes in a straight end accident.
What I feel Sad about is how
easily our media branded an Accident as a Murder. And then stuck to the story
as a murder. The questions which were needed to be asked were left unanswered
as the Politicians Hijacked the matter. The Family of Mr. Kumar alleges that
his fight against corruption has caused his death. Though we don’t have any
proof that this is true, Even if it was, it didn’t require the top most
investigation authority investigating the case. Are we trying to Project that
our Police officers aren’t competent enough to handle such cases?
Though the Most Sad part of
this story is, that none of the media followed up on the story. This Happens in
so many cases, They spring up the story, project it as the most important thing
happening in the country, then leave it just like that only to never show it
ever again. None of the Media houses, Had the courage to stand up and say, “yes
We made a mistake, it wasn’t a Murder, It was just a accident”. I didn’t see a
single report on any of the news channels. No newspapers carried the story as
well. The Only paper which had some dignity left, Was The Dainik Bhaskar, Its
12th may edition, Carried the story on the front page stating that
it was just an accident, and not murder.
Mr. Anna Hazare and His Team
of so called “Civil Society” Went to the extent of holding a protest at the
Jantar mantar in Delhi, and I’ll quote his Column at their Site Which you Can Read yourself At http://news.indiaagainstcorruption.org/?p=4086
“The brazen killing of 2009-batch IPS officer Narender Kumar
by the mining mafia in central Indian state Madhya Pradesh seems to be caught
in the quagmire of political accusations between the Congress and the ruling
Bharatiya Janata Party. Team Anna believes that the political parties are
deliberately raking up the war of words for two reasons; to scuttle justice to
the family of 30-year-old brave-heart who single handed took over the mafia
that is patronized by politicians in the state and keep the much needed
stringent whistle-blowers protection law as propounded in the Jan Lok Pal bill
in cold storage.”
So every thing that happens, According to Mr. hazare, Has
something or the other to do with stopping the jan lokpal bill. And I still
don’t get how a Anti-Corruption bill would have stopped the Accident from
taking place. But as they say, In Old age . . .
Well, I’d rather Not Complete it, Everyone already know what
the saying is.
Another Thing With our Media, it only projects what they
believe that people want to see, while they’ll not show the similar stories
taking place in different circumstances. So if A BMW Driver hits a
auto-rickshaw injuring the Driver, That would immediately flash as the Breaking
News in all the channels, Yet When a Boat Capsizes in Asom killing over 100
people, That wouldn’t even feature on most of the news channels, Let alone
carrying a feature. A Car owned by Salman khan, Driven by his Driver, Crushes 7
people on the footpath killing 2 of them, To whom he provides Homes, A
Compensation that can’t even be imagined, Gets the airtime of atleast 10 hours
in a week. Whereas a Drunk Truck Driver would ram into 8 cars killing over 16
people wouldn’t Even Get a mention.
Our Media Needs to get its Priorities right.
According to The Indian Penal Code, it Is a culpable
homicide and not a murder if the act is committed-
Without premeditation
In a sudden fight
In the heat of passion
Upon a sudden quarrel and
Without taking undue advantage.
Mr. Narendra Kumar was No doubt a Great Officer and a Good
man. He Was taking steps to curb the mining mafia’s involvement in the area.
His death is Indeed a big loss to the country. But We all Should remember, That
this wasn’t a murder. It was a Culpable homicide. About Time Media learns a Lesson and Mends its ways.
